On October 27, 2005, a $5,420.33 merchant direct deposit was made - per Mr. Kaufman's instructions - into his checking account at Washington Mutual.  Washington Mutual accepted the deposit on October 28, 2005.  On October 31, 2005, Mr. Kaufman telephoned to Washington Mutual customer service.  Because the deposit was suspiciously not posted, a recording of the conversation was made.  The telephone representative acknowledged that she saw the deposit had been received, but was dumbfounded as to its failure to post.  Mr. Kaufman then contacted the depositing financial institution and confirmed that the below deposit had been made.  Subsequent contact initiated by Mr. Kaufman - both by email and telephone - and witnessed in whole or in part by Mr. Kaufman's business counsel - was met by Washington Mutual staff with what appears to be a display, if not a sarcastic one, of ignorance.  Witness the history of communication.  Mr. Kaufman's requests for an official representative of Washington Mutual to contact said counsel have been received but ignored by Washington Mutual.  As a result of these and other actions and inactions, Mr. Kaufman has been and continues to be to a growing extent, harmed.  By its failure to timely and reasonably respond to Mr. Kaufman's inquiries in an efficient and meaningful way, Washington Mutual admits the facts as Mr. Kaufman has stated and intentionally exacerbates the damage to him, his business and his family.
